General Terms and Conditions (GTC) – Apartments Bauer

I. Scope of Application

1. These General Terms and Conditions (GTC) apply to all contracts concerning the temporary rental of apartments for the accommodation of guests and any related services and deliveries by Apartments Bauer, owner: Benedict Bauer, to third parties (hereinafter referred to as "Guest").
2. These are commercial accommodation contracts, not private lease agreements.

II.  Conclusion of the Contract

1. The accommodation contract is concluded when a booking request from the guest is confirmed in writing by Apartments Bauer (e.g., via email) or through the booking system.
2. The booking becomes binding as soon as the booking confirmation is sent.

III.  Services, Prices, Payment

1. The contractually agreed services are outlined in the respective booking confirmation.
2. The stated prices are final prices and include statutory value-added tax (VAT).
3. The total amount must be paid, unless otherwise agreed, no later than 7 days before arrival. Payment can be made in advance via bank transfer or through online payment services.

IV. Cancellation by the Guest / No-show

1. Cancellations must be made in writing.
2. Free cancellation is possible up to 14 days before arrival.
3. Cancellations up to 7 days before arrival will incur 50% of the total price.
4. Cancellations made later or no-shows will result in 100% of the total price being charged.
5. The time of receipt of the cancellation by Apartments Bauer is decisive.
6. The guest may provide evidence of a lesser damage.
7. Apartments Bauer reserves the right to prove a higher damage.

V. Withdrawal by the Provider

1. Apartments Bauer is entitled to withdraw from the contract for important reasons, particularly in the event of: 

a) Force majeure or other circumstances beyond control that make performance

b) Bookings made under misleading or false

c) Payment default despite

2. In such cases, the guest has no claim for compensation.

VI. Use / House Rules

1. The apartments may only be used for residential purposes by the persons specified in the booking.
2. Events, parties, and subletting are prohibited.
3. The house rules, which are part of the contract, must be adhered to.
4. Noise disturbances must be avoided – especially during the quiet hours between 10:00 PM and 7:00 AM.

VII. Liability

1. The guest is liable for any damage to the apartment or its inventory caused by them or accompanying persons.
2. Apartments Bauer is only liable in case of gross negligence or intent.
3. Apartments Bauer assumes no liability for items brought by the guest.
4. The use of facilities and equipment (including Wi-Fi, bicycles, washing machines, etc.) is at the guest's own risk.

VIII. Arrival and Departure

1. The apartment will be available to the guest from 3:00 PM on the day of arrival.
2. The departure must take place by 11:00 AM, unless otherwise agreed.
3. A late departure may result in an additional day's charge.

VIIIa. Registration Form and Access to the Accommodation

1. In accordance with Section 29 of the German Federal Registration Act (Bundesmeldegesetz), Apartments Bauer is legally required to collect certain personal data from guests prior to their stay. For this purpose, a digital registration form will be provided via a link sent to the guest before arrival.

2. The guest is obligated to complete the digital registration form truthfully and in full prior to arrival.

3. Access to the accommodation will only be granted once the registration form has been properly and completely filled out. If the guest fails to meet this obligation, Apartments Bauer reserves the right to deny access until the completed form has been received. In such cases, the guest shall not be entitled to any refund or compensation.

IX. Internet

1. Internet access via Wi-Fi is included in the rental price.
2. The landlord assumes no liability for any failure of the internet connection due to external circumstances (e.g., network outage, overload).
3. The guest agrees to use the internet only within the limits of the law.

X. Maintenance of the Rental Property

1. Any damage to the property occurring during the stay must be reported to the landlord immediately.
2. The guest is required to treat the apartment with care.
3. The guest is liable to the landlord for damages resulting from a violation of their duty of care and reporting.

XI. Shared Facilities

1. Washing machines and dryers are available to the guest in the communal areas of the basement for a fee.
2. These devices are used at the guest's own risk.
3. The devices must be handled carefully and appropriately.

XII. Bicycle Rental

1. Apartments Bauer provides bicycles to its guests free of charge upon request.
2. The use of the bicycles is at the guest's own risk.
3. The guest agrees to check the bicycle for road safety (e.g., brakes, lights, tire pressure) before each use.
4. Apartments Bauer is not liable for any damages caused by the use of the bicycles, whether to the bicycle, third parties, or the guest, unless there is intentional or gross negligence.
5. The guest is liable for any damages caused to the bicycle or to third parties.
6. The bicycles may only be used by the guests specified in the booking and may not be transferred to third parties.
7. The guest is required to secure the bicycle with the provided lock when it is not in use and to park it only in safe, authorized locations.
8. Loss of the bicycle or lock will result in the guest being liable for the resulting damage.
9. Authorized parking spaces include public or specially designated bicycle Parking at trees, driveways, traffic signs, or emergency lanes is prohibited.

XIII. Severability Clause

1. If any provisions of these GTC are or become invalid or unenforceable, the validity of the remaining provisions will not be affected.
2. The invalid provision will be replaced by an economically equivalent provision.

XIV. Jurisdiction / Applicable Law

1. The law of the Federal Republic of Germany shall apply.
2. The jurisdiction for all disputes arising from the accommodation contract shall, to the extent permitted by law, be the location of Apartments Bauer.
